These Terms of Service (“Terms”) apply to this website and to sales and services provided by ARCO Contractors Supply Co. (“ARCO,” “we,” “us”) to contractors and commercial construction customers (“Customer,” “you”). By using this website or placing an order with us, you agree to these Terms, unless a different written agreement between you and ARCO says otherwise.
1. Wholesale building materials and contractor supply sales
ARCO sells and distributes building materials, concrete construction products, tools, equipment, and job-site supplies on a wholesale, business-to-business basis. Sales are made to contractors and commercial construction customers.
2. Construction products, tools, and equipment
Descriptions of product categories on this website are general and are for information only. The specific product, specifications, and quantities for any sale are those stated in the quote, order confirmation, or invoice. You are responsible for selecting products and equipment that are suitable for your project and for confirming that they meet the requirements of your plans, specifications, and applicable codes.
3. Product availability
Product availability changes and is not guaranteed until confirmed by ARCO for your specific request. Nothing on this website is an offer to sell a particular product or quantity.
4. Quotes and pricing
Quotes are prepared on request and are based on the information you provide. A quote is not a binding sales contract until the order is confirmed by ARCO. Pricing and availability may change, and quotes may state a period during which they remain valid. Taxes, delivery charges, and other charges, where applicable, are in addition to quoted product prices unless the quote says otherwise.
5. Purchase orders
Where applicable, you may place an order using a purchase order. A purchase order is subject to acceptance by ARCO, and these Terms apply to it. Terms printed on a purchase order do not change these Terms unless ARCO agrees to them in writing.
6. Invoice-based payments
Where applicable, ARCO may invoice customers for products and services. Payment terms are those stated on the invoice or agreed in writing. You agree to pay invoices according to those terms.
7. Deposits and advance payments
Where applicable, ARCO may require a deposit or advance payment, for example for special orders or certain equipment or repair work. When one is required, it will be identified in the quote or order confirmation.
8. Order changes and cancellations
Please contact us as soon as possible if you need to change or cancel an order. Changes and cancellations are subject to ARCO’s approval and may not be possible once materials have been ordered, cut, prepared, or released, or for special-order items. Costs already incurred may remain your responsibility.
9. Delivery or pickup
Where applicable, orders are available for pickup or delivery as arranged with ARCO. Delivery and pickup dates and times are estimates unless ARCO confirms otherwise in writing and are not guaranteed. You are responsible for providing accurate delivery information and safe, accessible delivery or unloading conditions. Responsibility for the products passes to you when they are delivered to you or picked up by you or your carrier.
10. Equipment repair services
ARCO provides equipment repair and related support services. Repair eligibility, parts availability, service scope, pricing, and turnaround times vary depending on the equipment and the problem, and are reviewed and discussed with you for each request. ARCO may decline a repair request. Estimates are not guarantees, and the final scope or price may change if additional issues are found, in which case ARCO will contact you before proceeding where practicable. Please tell us about any known hazards or conditions relating to the equipment you submit. ARCO does not provide any warranty or guarantee on repair services unless it states one in writing for the specific job.
11. Receiving and inspection
Please inspect products when you receive or pick them up. Notify ARCO promptly, and preferably in writing, of any visible damage, shortage, or discrepancy with your order, and note it on the delivery or pickup document where possible. Prompt notice helps us review your concern.
12. Returns
Where applicable, returns must be requested from and approved by ARCO before products are sent back. Special-order, cut, custom, used, or damaged items may not be eligible for return. Conditions such as restocking charges, where applicable, will be explained when a return is approved.
13. Manufacturer warranties
Where a manufacturer provides a warranty on a product, that warranty is provided by the manufacturer, only where it actually applies, and on the manufacturer’s terms. ARCO does not provide a warranty of its own unless it states one in writing. To the fullest extent permitted by law, products and services are otherwise provided without warranties, express or implied.
14. Limitation of liability
To the fullest extent permitted by law, ARCO is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, project delays, or downtime, arising from products, equipment, repair services, or your use of this website. To the fullest extent permitted by law, ARCO’s total liability for any claim relating to a sale or service is limited to the amount you paid to ARCO for the specific product or service that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Website use
Information on this website is provided for general information. We work to keep it accurate, but it may contain errors or become out of date. You agree to use the website lawfully and not to interfere with its operation.
16. Governing law
These Terms and any sale or service by ARCO are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
17. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they were last changed. A written agreement signed by ARCO that conflicts with these Terms controls for the transactions it covers.
